1. Agreement to Terms

By accessing our website and engaging our services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must refrain from using our services or accessing our site content.

2. Scope of Services

MadO Brands delivers premium design, branding, packaging, marketing adaptations, and motion graphics solutions. Each project will be governed by a separate, agreed-upon creative brief or statement of work (SOW) specifying milestones, pricing structures (Project-based or Monthly Retainer), and delivery timelines.

3. Intellectual Property & Ownership

We take intellectual property rights seriously:

• Agency Property: All drafts, initial sketches, discarded concepts, and style exploration assets remain the exclusive property of MadO Brands.
• Client Ownership: Upon completion of the project and clearing of all final invoice payments, full copyright ownership and intellectual property rights of the finalized design deliverables (logos, packaging layouts, typography files) are fully transferred over to the client.
• Portfolio Usage: Unless explicitly agreed otherwise under a signed Non-Disclosure Agreement (NDA), MadO Brands retains the right to display the completed designs and packaging renderings in our portfolio for self-promotional purposes.

4. Client Cooperation & Approvals

To ensure quick delivery, client cooperation is required. Clients agree to provide complete assets (copy, product details, reference graphics) in a timely manner. Delays in reviews, feedback, or milestone sign-offs may result in rescheduled completion timelines.

5. Payment Terms & Billing

Engagements are billed based on the selected package or custom scope:

• Project-Based: Typically requires a 50% deposit before design startup, with remaining milestones billed upon final delivery approvals.
• Monthly Retainer: Billed in advance at the start of each month. Work will pause if retainer balances are overdue.
• Currencies: Payments will be processed in the currency selected during agreement (USD, INR, GBP, or EUR).

6. Limitation of Liability

MadO Brands is not liable for indirect, incidental, or consequential damages (including loss of profits, printing issues, or trademark availability) arising from client usage of design deliverables. It is the client's sole responsibility to ensure packaging copy compliance and complete national/international trademark validation.

7. Governing Law

These Terms & Conditions are governed by the laws of Kerala, India. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts located in Kottayam, Kerala.
